Terms of Use

1. Acceptance of Terms
By accessing or using Hadithi (the "Service"), you agree to be bound by these Terms of Use (the "Terms"). If you do not agree with any part of these Terms, you must not use the Service.
2. Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account or make a purchase. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
3. Your Account
- Provide accurate, current, and complete information during registration.
- Keep your credentials confidential and do not share your account.
- You are responsible for all activity that occurs under your account.
- Notify us immediately at peter@uhandisihub.com of any unauthorized use.
4. Buying Books
- Prices are shown in Kenyan Shillings (KES) unless stated otherwise and may change without notice.
- Payments are processed through M-Pesa or your Hadithi wallet balance.
- On successful payment, you receive a non-exclusive, non-transferable licence to read the book for personal, non-commercial use.
- You may not redistribute, resell, publicly share, or remove protection from purchased content.
- Rentals expire automatically at the end of their rental period.
5. Selling Books
If you upload a book for sale, you represent and warrant that:
- You are the author or have all necessary rights, licences, and permissions.
- Your content does not infringe any third-party copyright, trademark, or other right.
- Your content is not unlawful, defamatory, or obscene.
- Your metadata (title, author, description, pricing) is accurate.
You grant Hadithi a worldwide, non-exclusive licence to host, reproduce, distribute, and display your content for the purpose of operating the Service and fulfilling buyer orders. You retain ownership of your content.
Seller payouts are credited to your Hadithi wallet after a platform fee. Withdrawals are subject to the withdrawal rules and limits displayed in the wallet.
6. Refunds
Because digital content is delivered instantly upon purchase, sales are generally final. If you believe a purchase was made in error, the file is corrupted, or there is a billing mistake, contact us within 7 days and we will investigate in good faith.
7. Prohibited Conduct
You agree not to:
- Upload or share content you do not own or have the right to distribute.
- Upload malware or attempt to compromise the Service's security.
- Use bots, scrapers, or automated means to access the Service.
- Attempt to reverse-engineer, decompile, or tamper with the platform.
- Harass, threaten, or impersonate other users or our staff.
- Use the Service for any unlawful purpose or in violation of these Terms.
8. Intellectual Property
The Service, including its software, design, trademarks, and original content, is the property of Hadithi by Uhandisi Hub and is protected by intellectual property laws. Nothing in these Terms transfers any rights to you except the limited licence to use the Service.
9. DMCA & Copyright Claims
If you believe content on Hadithi infringes your copyright, send a written notice to peter@uhandisihub.com with:
- Identification of the copyrighted work.
- Location of the allegedly infringing material on the Service.
- Your contact information and a statement made in good faith.
- Your physical or electronic signature.
We will review and, if appropriate, remove or disable access to the content, and we may terminate repeat infringers' accounts.
10. Termination
We may suspend or terminate your access to the Service at any time, without notice, for conduct that we reasonably believe violates these Terms or is harmful to other users, us, or third parties. You may close your account at any time by contacting support.
11. Disclaimers
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that content will be accurate or available at all times.
12. Limitation of Liability
To the fullest extent permitted by law, Hadithi and its owners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim arising out of or related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
13. Governing Law
These Terms are governed by the laws of the Republic of Kenya, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
14. Changes to These Terms
We may update these Terms from time to time. Material changes will be announced via the platform or by email. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
